Terms of Use

1. Purpose

   • The Site is the property of Consulting Convergence & System SA, hereinafter 2CS SA, with its offices in Avenue de Champel 29, 1206 Geneva, Switzerland.
   • It consists of a set of pages that can be viewed by following the hyperlinks within the Site. The following are an integral part of this Site: the visual identity, the software development and all the information contained on the Site, intended to present the company 2CS SA and its services.
   • The information presented on the Site has only descriptive and informative value and it is not legally binding. It can be modified at any time by the Site owner without any obligation to inform the users. Your continued use of the Site following the changes is worth acceptance of these changes.

2. Availability

   • The access to the Site requires an Internet connection. There is no obligation whatsoever for 2CS SA to make its Site available.
   • 2CS SA excludes all liability regarding the availability or unavailability of information or access to/from the Site.
   • The Site does not claim to present our services in an exhaustive and precise manner. It is possible that services presented here are no longer relevant or that services offered by 2CS SA do not appear on the Site.

3. Intellectual Property Rights and License

   • All trademarks, both registered and unregistered, commercial signs, logos, business names, copyrights, all database rights and any other intellectual property rights of any kind, as well as those relating to the underlying software code, are the property of 2CS SA. The rights arising from licenses that 2CS SA may grant to its partners are reserved.
   • It is forbidden for third parties to copy or use images, texts and information from or related to the Site without the express written agreement of 2CS SA.
   • 2CS SA reserves the right to act before the competent court, as stated below, for repairs and/or stoppage of the disturbance.

4. Data Protection

   • Unless expressly requested by an officer of 2CS SA and except for the purpose of placing an order, you should not provide personal data through the Site.
   • Where appropriate, the personal information you provide through the Site is protected in accordance with its Privacy Policy.

5. Accounts and Security

You are responsible for maintaining the confidentiality of any password you are given to access the Site and are fully responsible for all activities that occur under your password. You agree to notify us immediately of any unauthorized use of your password.

6. Limitation of Liability

   • In any case and to the extent permitted by the applicable law, 2CS SA shall not be held liable for any direct, indirect, special, punitive, exemplary or immaterial loss or damage of any nature whatsoever arising from the use or access to the Site, including loss of profit or the like, whether in contract, tort, including negligence, product liability or otherwise resulting from the use of the Site.
   • 2CS SA is not held liable for damage or alterations of equipment, including, without limitation, any computer hardware, mobile devices or mobile phones, as a result of the use of the Site.
   • Our Site may refer to third-party websites that are not maintained by 2CS SA. We exclude any responsibility for the content, accessibility of viability of these websites.
   • You agree to defend, indemnify and hold harmless 2CS SA, its officers, directors, employees, partners and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of our Site.
   • You agree to not use the Site and your account on the Site to conduct any criminal or fraudulous activity. 2CS SA declines any liability for such occurrences.

7. Termination

These Terms of Use apply to you as long as you use our Site. You can discontinue its use at any time. Moreover, 2CS SA can shut down its Site at any time, without any obligation to inform the users and without legal obligations towards them.

8. Opposability

The above conditions are supposed to be known and accepted. No one can avail themselves from their lack of knowledge in order to bring action against 2CS SA.

9. Partial Nullity

If any provision of these Terms of Use are found to be unenforceable, only such provision will be void. The remainder of the Terms of Use shall stand fully enforceable.

10. Jurisdiction and Applicable Law

These Terms of Use shall be governed by the Swiss law. The Courts of the Canton of Geneva are competent to hear any dispute that may arise from these Terms of Use. The appeal to the Swiss Federal Supreme Court is reserved.
